Studio Regulations & Terms of Use
Welcome to ENSO STUDIO
These Studio Regulations and Terms of Use form an integral part of the membership agreement between the Client and ENSO STUDIO.
By booking a session, purchasing a membership or package, or participating in any activity at ENSO STUDIO, you acknowledge that you have read, understood, and accepted these Regulations and Terms of Use in full.
ENSO STUDIO reserves the right to amend these Regulations and Terms of Use at any time in order to ensure the smooth operation of the studio, the safety of its members, and the quality of the services provided.
At ENSO STUDIO, we believe that lasting results come from the right balance of safety, personalised coaching, and respect for every individual. These Regulations and Terms of Use are designed to ensure a safe, enjoyable, and high-quality experience for all our members.
Article 1 – Obligations of the Studio
ENSO STUDIO is committed to:

Providing professional coaching and supervision.

Using well-maintained, high-quality, and compliant equipment.

Adjusting the intensity of each session according to the client's profile, available information, and real-time feedback.

Taking all reasonable measures to ensure the safety and well-being of every client throughout each session.
Article 2 – Coach's Authority
The coach may, at their sole discretion, even if requested otherwise by the client:
-
interrupt or terminate a session;
-
reduce the intensity of a session;
-
refuse to conduct a session.
Article 3 – Conduct of the Sessions
The Client agrees to:
-
follow the coach's instructions at all times;
-
immediately report any unusual pain or discomfort;
-
stop the session immediately if they feel unwell;
-
wear appropriate training attire.
Article 4 – Session Bookings
All sessions are available by appointment only.
Each time slot is reserved exclusively for an individual member or a duo, with a dedicated coach assigned to the session. Once confirmed, a booking reserves both coaching time and studio resources exclusively for that member.
Members are expected to attend all sessions they book.
Article 5 – Punctuality
To ensure the best possible ENSO experience and the smooth running of all sessions, members are required to arrive 15 minutes before their scheduled appointment.
This time is dedicated to welcoming members, preparing the EMS equipment, and enjoying the pre-session experience that is an integral part of the ENSO concept.
In the event of a late arrival:
-
If the delay is minor and the session can still be conducted safely and effectively, the session will proceed. However, the time lost due to the delay will be deducted from the scheduled session duration and cannot be made up.

If the delay is considered excessive and compromises the quality of the coaching, the safety of the session, or the schedule of other members, the coach reserves the right to refuse the session.
In such cases, the session will be considered as used and will be deducted from the member's membership or package. No refund, replacement session, or rescheduling will be offered.
The decision as to whether a late arrival is acceptable rests solely with ENSO STUDIO.
Article 6 – Cancellations, Rescheduling and Missed Sessions
Any cancellation or request to reschedule a session must be made at least 24 hours before the scheduled session time.
Any request received after this deadline will be considered a late cancellation. In such cases, the session will be deemed to have been attended and will automatically be deducted from the member's membership or package.
However, at its sole discretion, ENSO STUDIO may accept an exceptional rescheduling request if the member provides, within 48 hours, valid supporting documentation demonstrating circumstances beyond their reasonable control (such as a medical certificate, official documentation, proof of an accident, or any other document deemed acceptable by ENSO STUDIO).
ENSO STUDIO reserves the sole right to determine the validity and acceptability of any supporting documentation provided.
In the event of a No-Show (failure to attend without prior notice), the session will automatically be considered as used. No refund, credit, replacement session, or rescheduling will be granted.
Make-up Sessions
Missed sessions may be made up under the following conditions:

Members may attend up to two sessions per week, subject to availability.
-
If all sessions have not been completed before the end of the membership period, an additional one-month grace period will be granted to allow the remaining sessions to be completed.
At the end of this grace period, any unused sessions will expire permanently and no refund, compensation, extension, or further rescheduling will be granted, except in exceptional circumstances approved at the sole discretion of ENSO STUDIO Management.
Article 7 – Payment Terms
Membership fees may be paid using the payment methods accepted by ENSO STUDIO at the time of enrolment (TWINT, credit or debit card, etc.).
Any late or missed payment may result in one or more of the following:
-
the immediate suspension of the member's access to services;
-
the issuance of one or more payment reminders;
-
the application of reminder fees, where permitted under Swiss law;
-
the initiation of debt collection proceedings.
The Client remains liable for all outstanding amounts, even if access to ENSO STUDIO's services has been suspended due to non-payment.
Article 8 – Memberships and Validity
Memberships and session packages are personal, non-transferable, and may only be used by the registered member.
They may not be lent, sold, assigned, or transferred to any third party without the prior written consent of ENSO STUDIO.
All sessions must be used within the validity period of the membership or package, subject to the additional grace period described in Article 6.
Any unused sessions remaining after the expiry of this period will be permanently forfeited, without refund, credit, or compensation.
Article 9 – Membership Suspension
A temporary suspension of a membership (for a maximum period of three (3) months) may only be granted in the following circumstances:
-
upon presentation of a medical certificate temporarily prohibiting the member from engaging in any physical activity; or
-
in any other exceptional circumstance expressly approved by ENSO STUDIO Management.
All suspension requests must be submitted in writing and accompanied by the appropriate supporting documentation.
ENSO STUDIO reserves the right, at its sole discretion, to approve or refuse any request for membership suspension.
Article 10 – Liability
The member participates in all sessions under the supervision of a coach and agrees to follow all instructions provided.
ENSO STUDIO shall not be held liable for any injury, loss, or damage resulting from:
-
inaccurate, incomplete, or misleading medical information provided by the member;
-
failure to follow the coach's instructions;
-
improper or unauthorized use of the equipment;
-
reckless, negligent, or unsafe behaviour.
ENSO STUDIO shall not be held liable for any consequences arising from a medical condition or contraindication that has not been declared by the member.
Article 11 – Alcohol and Drugs
ENSO STUDIO reserves the right to refuse a session to any person who:
-
is under the influence of alcohol;
-
is under the influence of drugs or any other intoxicating substance;
-
is clearly unable to participate safely in the session.
Article 12 – Hygiene and equipment
All EMS suits, arm straps, connected sensors, towels, bathrobes, and any other equipment provided remain the exclusive property of ENSO STUDIO.
The Client agrees to use all equipment with due care and to return it to the designated areas immediately after each session.
Any loss, intentional damage, or excessive wear and tear may result in the Client being charged the cost of repair or replacement.
Each member is responsible for keeping the changing rooms, toilets, and showers clean and tidy after use.
ENSO STUDIO reserves the right to refuse access to its facilities for reasons of health, hygiene, or safety.
Article 13 – Force Majeure
ENSO STUDIO shall not be held liable for any failure or delay in providing its services due to a Force Majeure event, including, but not limited to, pandemics, fires, natural disasters, widespread technical failures, government orders, or any other event beyond its reasonable control.
Article 14 – Respect for the Studio and Its Facilities
To preserve the calm, welcoming, and premium atmosphere that defines ENSO STUDIO, every Client agrees to behave respectfully towards:

other members;
-
coaches and staff;
-
the studio's facilities and equipment.
Any aggressive, abusive, violent, discriminatory, disruptive, or otherwise inappropriate behaviour, or any conduct likely to damage the reputation, safety, or proper operation of ENSO STUDIO, may result in the immediate suspension or permanent termination of the Client's membership, without refund.
Article 15 – Mobile Phones and Photography
To protect the privacy, confidentiality, and comfort of all members, it is strictly prohibited to photograph, film, or record any person within ENSO STUDIO without their prior consent.
ENSO STUDIO reserves the right to require the immediate deletion of any photos, videos, or other content created in breach of this policy.
Any photography or filming within ENSO STUDIO is subject to the prior consent of all individuals concerned and, where applicable, the prior approval of ENSO STUDIO.
Article 16 – Minors
Minors are not permitted to access the services provided by ENSO STUDIO.
Article 17 – Personal Effects
ENSO STUDIO shall not be held liable for the loss, theft, or damage of any personal belongings brought onto or left on the studio premises, including in the changing rooms.
Each member is solely responsible for the safekeeping of their personal belongings at all times.
Article 18 – No Guarantee of Results
ENSO STUDIO is committed to providing members with professional coaching and personalised support to help them achieve their goals. However, no specific aesthetic, athletic, medical, or performance-related results can be guaranteed.
Results vary from one individual to another and depend on a number of factors, including the regularity of attendance, nutrition, lifestyle, sleep quality, individual physiology, and the member's commitment to the programme.
Article 19 – Right of refusal and termination
ENSO STUDIO reserves the right to suspend or terminate any membership with immediate effect in the event of:
-
failure to comply with these Studio Regulations and Terms of Use;
-
behaviour that is incompatible with the values of ENSO STUDIO;
-
conduct that endangers the health, safety, or well-being of others;
-
intentional damage to the studio's equipment or facilities;
-
or any other behaviour likely to compromise the safety, peaceful environment, reputation, or proper operation of ENSO STUDIO.
Such a decision may be taken without any refund of membership fees or other sums already paid, subject to any mandatory provisions of applicable Swiss law.
Article 20 – Personal Data
Personal data collected by ENSO STUDIO is used exclusively for the purposes of administrative management, session bookings, sports and health monitoring, member relationship management, and the provision of ENSO STUDIO's services.
All personal data is processed in accordance with applicable Swiss data protection legislation, including the Federal Act on Data Protection (FADP).
Article 21 – Governing Law
These Studio Regulations and Terms of Use are governed by the laws of Switzerland. Subject to any mandatory provisions of applicable law, the courts of Geneva shall have exclusive jurisdiction.
